Geopolitical Trade and Legal Contestation: The Enduring Volatility in U.S.–Asia Economic Relations

The Asia-Pacific economic environment is increasingly shaped by a complex mix of fragile diplomatic detente, realignment of supply chains, and legal uncertainty originating in the United States. While regional equity indices, such as South Korea’s KOSPI, retreated in cautious trading amid earnings concerns and a delayed U.S. jobs report, business watchers are more deeply worried about evolving trade-law risks. The U.S. administration, demonstrating a recalibrated trade strategy, issued a Nov. 14 executive order exempting certain agricultural goods, including coffee and tropical fruits, from its reciprocal tariff regime, aiming to relieve non-domestic producers and influence supply-chain sourcing.

This move comes as the U.S. faces one of the most significant legal challenges to presidential trade authority in decades. The Supreme Court is reviewing consolidated cases (e.g., Learning Resources v. Trump and V.O.S. Selections, Inc. v. Trump) that question whether the International Emergency Economic Powers Act (IEEPA) actually authorizes the sweeping tariffs imposed under recent executive orders. Earlier, the U.S. Court of International Trade ruled the IEEPA-based tariffs exceeded the president’s power, and in August 2025 the U.S. Court of Appeals for the Federal Circuit affirmed parts of that ruling. As the legal battle continues, refund risk looms large for importers, and companies are advised to maintain rigorous compliance and prepare for possible duty repayments. 

At the same time, the U.S.–China trade truce reached during the President’s Asia trip reflects a delicate balance between political compromise and more fundamental economic shifts. Although Beijing has suspended certain export controls on critical minerals and backed off retaliatory tariffs on U.S. agricultural goods, U.S. soybean purchases, a key metric for the agreement, remain well below the targets set in the deal. State-owned Chinese buyers’ reluctance to quickly return to pre-conflict sourcing in part highlights how supply chains continue to realign in favor of other commodity exporters, particularly in South America.
